These terms and conditions are applicable to the use of ESSENTIALAFRICA.COM, it's services and content.

By viewing ESSENTIALAFRICA.COM content i.e. pictures, video, graphics, sound and text, it implies that you accept these terms and conditions.

GENERAL

1. ESSENTIALAFRICA.COM is not liable for the content displayed on the site or third party link accessed from it. This includes any loss, damage or injury incurred by using the information provided on this website.
2. We have the right to refuse to post or to edit submitted content. We reserve the right to remove content for any reason, but we are not responsible for any failure or delay in removing such material. We do not however have a duty to pre-screen content. If you see illicit content please flag it to us by emailing advertising@essentialafrica.com
3. Although we do our utmost in providing seamless internet access to ESSENTIALAFRICA.COM, we cannot guarantee this and are not responsible or liable for any interruption or delay.
4. You may print or download content from the site for personal or non-commercial use only. You may not extract information systematically (with or without the aid of software or any other mechanical means) to store in a database. If you would like permission to use the content on our site, please contact admin@essentialafrica.com.
5. You may not without prior consent use ESSENTIALAFRICA.COM logos or trademarks nor mention or refer to the site or brand in any manner.
6. You are solely responsible for any costs you incur to access ESSENTIALAFRICA.COM through any wireless or other communication service.
7. We may discontinue or change any service or feature on the website at any time and without notice. These terms and conditions can be changed at any time by ESSENTIALAFRICA.COM.

YOUR RESPONSIBILITIES

1. You may use ESSENTIALAFRICA.COM for lawful purposes only. You may not submit or transmit through ESSENTIALAFRICA.COM any material, or otherwise engage in any conduct that:
1. violates or infringes the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights,
2. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortuous, or contains explicit or graphic descriptions, or accounts of, sexual acts,
3. victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability,
4. impersonates any person, business or entity, including ESSENTIALAFRICA.COM and its employees and agents,
5. contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorized use of a computer or computer network,
6. encourages conduct that would constitute a criminal offense, or that gives rise to civil liability, violates these Terms of Use, guidelines or any policy posted on ESSENTIALFRICA.COM, or interferes with the use of ESSENTIALFRICA.COM by others.
2. You may not use ESSENTIALAFRICA.COM in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of ESSENTIALAFRICA.COM. You may not attempt to gain unauthorized access to any services, computer systems or networks, through hacking, password mining or any other means. We may take any legal and technical remedies to prevent the violation of this provision and to enforce these Terms of Use.
3. Any dealings that you have with advertisers found on ESSENTIALAFRICA.COM are between you and the advertiser and you acknowledge and agree that we are not liable for any loss or claim you may have against an advertiser.

DISCLAIMER OF WARRANTIES

1. We provide ESSENTIALAFRICA.COM as is, with all faults and as available.
2. We make no express warranties or guarantees. To the extent permitted by law, we and our suppliers disclaim implied warranties that ESSENTIALAFRICA.COM and all content and services distributed through it are merchantable, of satisfactory quality, accurate, timely, fit for a particular purpose on need, or non-infringing.
3. We do not guarantee that ESSENTIALAFRICA.COM will meet your requirements, is error-free, reliable, without interruption or available at all times. We do not guarantee that the results that may be obtained from the use of ESSENTIALAFRICA.COM, including any support services, will be effective, reliable and accurate or meet your requirements.
4. We do not guarantee that you will be able to access or use ESSENTIALAFRICA.COM (either directly or through third party networks) at times or locations of your choosing.
5. No oral or written information or advice given by an ESSENTIALAFRICA.COM representative shall create a warranty.
6. You may have additional consumer rights under your local laws that this contract cannot change.

ADVERTISING

The following terms and conditions ("Advertising Terms and Conditions") are deemed to be incorporated into each order for advertising ("Advertising Order") accepted by ESSENTIALAFRICA.COM:

1. Terms of Payment: The Advertiser must have paid any outstanding invoices before the advertising will appear on essentialafrica.com. Advertising will commence within three day of receipt of payment. Advertisement prices are subject to change without notice.
2. Positioning and License: Advertising space is subject to approval and availability. ESSENTIALAFRICA.COM shall be under no liability for its failure for any cause to insert an advertisement.
1. An advertisement url must open up in a new window while the existing ESSENTIALAFRICA.COM window remains open.
2. An advertisement may not resize itself to impede the view of the content, navigation or any other advertisement.
3. No redirected URLs. The advertisement may only link up with a listing in www.essentialafrica.com or a direct link of a working website. It cannot connect to an email address or file, and must not be under construction.
4. The advertisement messaging may not be deceptive or misleading to the user and must include the advertiser's trademark. The advertisement may not include excessive flashing animation, fake functionality (e.g. search form), free offers and sweepstakes or "fake winner" content.
3. Usage Statistics: Notwithstanding the provisions of the Advertising Order, the Advertiser acknowledges that ESSENTIALAFRICA.COM has not made any guarantees with respect to usage statistics, which include, without limitation, levels of impressions or click-throughs for any advertisement or for any position specified for each advertisement.
4. Right to Reject Advertisement. ESSENTIALAFRICA.COM reserves the right to accept or decline any advertisement proposal. All contents of advertisement are subject to essentialafrica.com approval. Advertisement may not contain content or images that imply or express:
1. Profanity
2. Sex, nudity, pornography
3. Foul, vulgar, obscene language
4. Political party motivation
5. Incite or advocate violence or racial intolerance
6. Content that promotes any illegal or dangerous activity
7. Content or technology that infringes, encourages, or enables the infringement of, the intellectual property or personal rights of others
8. Prejudice
5. Cancellations and Construction: The Advertiser cannot cancel the Advertising Order 2 weeks before the advertising campaign.
6. Advertisers may not without prior consent from Essential Africa use Essential Africa logos or trademarks nor mention or refer to Essential Africa, its site or brand in any manner.
7. Individual advertisers are solely responsible for the content of advertising material that they submit to us, and this includes ensuring that it complies with the relevant legislation. Essential Africa is not liable for incorrect information displayed by an advertiser.
8. By advertising with us, you acknowledge that Essential Africa has the sole right to review an advert and may remove it at its discretion.
9. Essential Africa reserves the right to add, remove or modify this policy at any time by placing updated advertising policies on Essentialafrica.com.
